TERMS AND CONDITIONS OF SALE

The general terms and conditions of sale apply strictly to all sales made through the online store top-refrigerants.com. Any orders made through the online portal top-refrigerants.com require the acceptance by the customer  the general terms and conditions of sale of the online store top-refrigerants.com shall be effective from the day of the respective order.

In addition, the Client confirms that the acceptance of these terms and conditions is related to the application of these terms to the order to which they apply as well as to subsequent orders, except in cases when new conditions are accepted and made available to you by the online shop top-refrigerants.com.

The fact that the online shop top-refrigerants.com doesn’t exercise the right to use any of these terms, can’t be interpreted and doesn’t mean abandoning it in the future or in the past.

The interpretation and application of the terms and conditions, as well as any acts deriving therefrom, must be subject to EU law, with the exception of existing provisions which are contrary to those provisions.

We reserve the right to make changes to these Terms and Conditions of Sale at any time and without notice, leaving it to you to read the General Terms and Conditions of Sale again before you place an order. Any amended terms will become effective from the date of publication on this site.

On the other side, the Customer, whose purpose is to be a consumer and/ or user and/ or a tenant of products or services provided by top-refrigerants.com .The customer and/ or the user is responsible for the information they provide to top-refrigerants.com.  Consequently, it is responsible for the reliability of the data provided on this site.

REGULATION

The new regulation on handling with fluorinated gases  is F-GAS 517/2014. The restrictions apply only to gases with high GWP value (> 1400).

The customer is obligated to send his fluorinates gas manipulator card during the purchase process, by e-mail or after receiving his merchandise.

Otherwise, if the customer doesn’t have the fluorinated gas handler card, according to the Ministry of the Environment and the EU, the purchase will only be possible if the customer declares that the use of the product will be destined to other activities that are not included in the CEE517/ 2014 law specifically in article 10. We inform our clients that according to the new law we are obligated to keep the sales book with complete data of the customers and the quantity purchased. The registry is available to the authorities upon request.

As regards the taxes on fluorinated gases applied in some countries, we suggest that the client inform himself about local laws before buying.

With regard to all gas subject to the European F-gas law 517/2014, our company reserves the right not to send the goods and refund the order if the buyer's company/tax informations has not been entered correctly. The sales register required by the above law cannot be completed correctly without these informations.

ORDERS

Orders can be made from this website on-line in top-refrigerants.comAll orders must be paid within 48 hours, otherwise they will be canceled.

All orders entail the acceptance of these Terms and Conditions, regardless of the way the order was made. In addition to being subject to revision, they could be cancelled before being sent without any type of compensation to the buyer due to typographical error, and exceptionally due to variation in the prices presented by the manufacturers of the products, due to modifications according to the variations of market and variations in raw materials, updating of catalogues or lack of stock/ availability. A request for a product with price 0will never be processed, considering that it is a typographical error. The conditions for which an order can be cancelled are found in a small percentage, but in all cases, if you wish to confirm your order, you can do it by e-mail.

PAYMENT METHOD

Payment method is by bank transfer. We are an intra-community company, for which prices are without VAT and taxes.

Www.top-refrigerants.com reserves the right to cancel the order and return the payment if it is believed that it is fraudulent.

SHIPPING POLICY

Orders are usually made by DHL, SEUR,  DPD, UPS, TIPSA shipping company. Orders are from Monday to Friday, with no holidays.  Then the expected delivery date will be confirmed to the customer by the transport company.

We can’t guarantee the exact delivery time. An order will be considered delivered when the delivery receipt is signed by the client. We are not responsible for the shipping costs if the data (full name, complete address, contact telephone number) for delivery is incorrect.

However, top-refrigerants.com declines all responsibility for the delay in deliveries of the package due to cases beyond our control.  All costs related to local taxes and charges, customs charges, or any other type in the country for which delivery is made shall be at the customer’s expense.

All shipments are delivered to the address in front of the front door of the street without any liability or obligation to place the goods to the apartment door, home, office, etc. If you would like this option, contact us and you will be provided with extra shipping charges up to your home or office.

Product are always sent after confirmation of their payment, taking into account the date of value indicated by the corresponding bank.

Top-refrigerants.com is NOT responsible for the failed delivery doe to the absence of the recipient of the address, the wrong postal code or the wrong name, etc. In these cases the customer must bear the cost of returning and telephone conversations with the carrier for information and/ or request a new delivery. If a new shipment is required due to customer’s fault, this will incur additional shipping costs.

Top-refrigerants.com is not responsible for the loss/ damage/ theft you should claim to the shipping company. The shipping fees added during the purchase do not include any insurance.

Some remote addresses require high delivery costs that our web site can not automatically calculate. In this case, our company reserves the right to charge an additional shipping charge and refunds entire order if the customer refuses to pay.

During high seasons, such as summer, deliveries may take longer than expected, due to the high demand for orders.

BILLING

The billing is only for commercial customers who have correctly registered and provided all the company's data, the INTRA VAT, the f-gas certificates and have signed the declaration fpr the use of F-GAS.
 
Local regulations relating to electronic commerce do not imply the mandatory issuance of the invoice to individuals or to customers who have not correctly entered all the company's data during the purchase.
 
If you need an invoice for your purchase, make sure you have it a few days after the delivery of the merchandise. If this does not happen, you have to request it directly from our customer service within the first 7 days of the month following the purchase.
 
No invoice can be issued after 30 days after receiving the payment and if the company's data has not been provided properly.

WARRANTY

Air conditioners have 2 year legal guarantee. Air conditioners must be installed by professional installers. In order for the warranty to be valid, it is necessary to present, within one month, the official installation warranty document (min 6 months), the certificate of authorized installer of air conditioning and invoice of the installation. The documents must be sent electronically.

The warranty depends on the inspection of our laboratory (or supplier’s laboratory), which determines the type of damage.

The warranty does not include damages caused by negligence, bumping, improper use and handling, materials subject to their normal wear or inadequate voltage, or improper installation that isn’t performed by the Authorized Service Center as appropriate.

The guarantee will lose its value:

  • If any of the proof of purchase data is changed, altered or replaced
  • If the identification number or the guaranteed device itself is manipulated or repaired without knowledge of the technical service.

Customers must use their own shipping agent to return the product and pay the shipping costs.

The guarantee concerning the net weight of the gas applies only if the package of container seal is intact.

The kits indicator/ gauge rating is only applicable if there are no overpressure/ high pressure signs.

Regarding the lack of weight (or excess) weight of the flocculated gas, we inform you that the factories operate at a standard trade tolerance of 2,5% due to changes in the working temperature.

Terms on refunds and cancellations 

For standard products, the right to return the purchase is fourteen (14) days from the day of delivery, and the returned merchandise will be checked. If it is not returned in perfect condition, 100% of its price will not be refunded. In case of return, must be in its original packaging, and the customer will bear the cost of transport.

No return of product(s) will be accepted under any pretext if they are not in the original packaging!

In case that customer chooses to exercise the right to return the goods, we require you to inform us by phone / email of your intention. Phone: +34 632 690 690 E-mail: [email protected]. We will provide you the return instructions over email or phone.

The product once installed is not subject to uninstalling and returning and/ or returning the installation price.

In case of receiving product damaged by the transport it is necessary within the first 24 hours to inform the transport company of the incident. The seller is responsible for errors that occur within 2 years from the date of delivery. The consumer must inform the seller of the lack of conformity within two months after he/ she knows about it.

The client will have 24 hours to check the integrity of all components of the appliance and check that there is everything that needs to be included in the product. After 24 hours, delivery will be deemed accepted and no claims for damages and/ or inconsistencies and delivery defects will be accepted.

After all return requirements are fullfilled the refund will be executed in maximum of 30 days.

PRECAUTION

Top-refrigerants.com is not responsible for any direct and indirect damages caused by improper and inappropriate use of the purchased products.

In regards to refrigerant gases, it is necessary to read the precautions indicated in the safety sheets.

INTRODUCTION

The image of the articles may differ from the images available on the website without changing the technical characteristics.

All items are new, unless otherwise indicates.

Bottles may have external signs of wear, scratches or lack of paint.
